Thank you for using the Cura Connect platform! We are confident that you will find our Services presented in the Application useful. Please read these Terms & Conditions carefully. By visiting the Application, downloading, using or accessing the Application on your Device, you hereby accept to be bound by these Terms & Conditions without any reservations, modifications, additions or deletions. If you do not agree to all the provisions contained in the T&C, you are not authorized to use the Application.

If you have downloaded the Application and do not agree to all the provisions of the T&C, you must delete the Application from your Device.

These Terms and Conditions (hereinafter “T&C”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”).

BY ACCEPTING THESE TERMS, YOU AGREE TO THESE TERMS AND CONDITIONS WITH Cura FZE. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS, YOU SHOULD NOT CLICK THE “I AGREE” BUTTON.

To be eligible to use a Cura Connect platform account and use the App, you must review and accept the terms of this T&C by clicking on the “I agree” button. By providing the data requested in the signup mask and clicking “I agree,” you make us an offer to enter into the Agreement based on these Terms.

Supplemental terms and conditions or documents that may be posted on the App from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these T&C at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of these T&C and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these T&C to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised T&C by your continued use of the App after the date such revised Terms are posted.

The information provided on the App is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the App from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

The App is intended for users who are at least 18 years old. All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the App. If you are a minor, you must have your parent or guardian read and agree to these T&C prior to you using the App.

We reserve the right, but not the obligation, to: monitor the App for violations of these T&C; take appropriate legal action against anyone who, in our sole discretion, violates the law or these T&C, including without limitation, reporting such user to law enforcement authorities; in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Contributions or any portion thereof; in our sole discretion and without limitation, notice, or liability, to remove from the App or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems; and otherwise manage the App in a manner designed to protect our rights and property and to facilitate the proper functioning of the App.

Unless otherwise indicated, the App is our proprietary property and all source code, databases, functionality, software, application designs, audio, video, text, photographs, and graphics on the App (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United Arab Emirates, foreign jurisdictions, and international conventions.

The Content and the Marks are provided on the App “AS IS” for your information and personal use only. Except as expressly provided in these T&C, no part of the App and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

Provided that you are eligible to use the App, you are granted a limited license to access and use the App and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the App, Content and the Marks.

By using the App, you represent and warrant that: all registration information you submit will be true, accurate, current, and complete; you will maintain the accuracy of such information and promptly update such registration information as necessary; you have the legal capacity and you agree to comply with these T&C; you are not a minor in the jurisdiction in which you reside, or if a minor, you have received parental permission to use the App; you will not access the App through automated or non-human means, whether through a bot, script or otherwise; you will not use the App for any illegal or unauthorized purpose; and your use of the App will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the App (or any portion thereof).

Account Registration
To use Cura Connect platform, an account will be created for you by your healthcare provider. Accounts are free and are available to anyone who provides the requisite information. As part of the account creation process, you will be asked to provide your name, email address, phone number and create a password.

It is your responsibility to create a password of sufficient strength that cannot easily be discovered by third parties, and that conforms to any password requirements that may be displayed during the registration process. Also, you agree to keep your password confidential and will be responsible for all use of your account and password.

Cura FZE reserves the right to terminate your account, at its sole discretion, at any time and for any reason, including but not limited to whether you have violated the letter or spirit of the T&C.

Prohibited Activities
You may not access or use the App for any purpose other than that for which we make the App available. The App may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

• Systematically retrieve data or other content from the App to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
• Make any unauthorized use of the App, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses.
• Use the App to advertise or offer to sell goods and services.
• Disparage, tarnish, or otherwise harm, in our opinion, us and/or the App.
• Use the App in a manner inconsistent with any applicable laws or regulations.

Mobile Application License
Use License
When accessing the App we grant you a revocable, non-exclusive, non-transferable, limited right to install and use the mobile application on wireless electronic devices owned or controlled by you, and to access and use the mobile application on such devices strictly in accordance with the terms and conditions of this mobile application license contained in these T&C.

The following terms apply when you use the mobile application obtained from either the Apple Store, Google Play or Huawei App Store (each an “App Distributor”) to access the App:

• The license granted to you for our mobile application is limited to a non-transferable license to use the application on a device that utilizes the Apple iOS, Google Android or Huawei Harmony operating systems, as applicable, and in accordance with the usage rules set forth in the applicable App Distributor’s terms of service.
• We are responsible for providing any maintenance and support services with respect to the mobile application as specified in the terms and conditions of this license or as otherwise required under applicable law. You acknowledge that each App Distributor has no obligation whatsoever to furnish any maintenance and support services with respect to the mobile application.
• In the event of any failure of the mobile application to conform to any applicable warranty, you may notify the applicable App Distributor, and the App Distributor, in accordance with its terms and policies, may refund the purchase price, if any, paid for the mobile application. To the maximum extent permitted by applicable law, the App Distributor will have no other warranty obligation whatsoever with respect to the mobile application.

Submissions
You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information regarding the App provided by you to us are non-confidential and shall become our sole property. We shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these Submissions for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you.

You hereby waive all moral rights to any such Submissions, and you hereby warrant that any such Submissions are original with you or that you have the right to submit such Submissions. You agree there shall be no recourse against us for any alleged or actual infringement or misappropriation of any proprietary right in your Submissions.

Terms and Conditions
For any business disputes, the App will only obey the laws of the UAE and not of any international laws, as Cura FZE is a UAE-based entity. Minors under the age of 18 are prohibited from registering as Users of Cura Connect or any of our other platforms.

General Data Protection Regulation (GDPR)
You have the following rights regarding your personal data held by Cura Connect platform:

• The right to withdraw your consent at any time.
• The right to have your personal data erased from our records.
• The right to correct your personal data if you believe it is inaccurate.
• The right to restrict processing if the data is inaccurate or our use is unlawful.
• The right to access your personal data and relevant processing information.
• The right to refuse any direct marketing communications from Cura FZE.

Personal Data Collected & Usage
We may collect the following data directly from you: full name, email address, phone number, and address. The purpose of processing this data is to communicate services and promotions with you. The legal basis for this processing is your consent.

Data Retention
Your personal data will only be retained for as long as is necessary to fulfill its processing purpose. For instance, we will retain account information for as long as your account remains active.

Term and Termination
These T&C remain in effect while you use the App.
WITHOUT LIMITING ANY OTHER PROVISION OF THESE T&C, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE APP TO ANY PERSON FOR ANY REASON OR NO REASON, INCLUDING WITHOUT LIMITATION BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE T&C OR ANY APPLICABLE LAW OR REGULATION.

We may terminate your use or participation in the App or delete your account and any content or information you posted at any time, without warning, at our sole discretion.

If we suspend or terminate your account, you are prohibited from creating a new account under your name, a fake name, or a third party’s name—even if acting on behalf of the third party. We also reserve the right to pursue appropriate legal action, including but not limited to civil, criminal, and injunctive remedies.

Modifications and Interruptions
We reserve the right to change, modify, or remove the contents of the App at any time or for any reason at our sole discretion, without notice. We are not obligated to update any content on the App.

We may also modify or discontinue all or part of the App at any time without notice. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the App.

We cannot guarantee the App will be available at all times. We may experience hardware, software, or other issues or perform maintenance that results in interruptions, delays, or errors. We reserve the right to revise, update, suspend, discontinue, or modify the App at any time or for any reason without notice.

You agree that we are not liable for any loss, damage, or inconvenience caused by your inability to access or use the App during downtime or discontinuance. These T&C do not obligate us to maintain or update the App in any way.

Governing Law
These T&C shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising under or related to these terms shall be subject to the exclusive jurisdiction of the courts in Abu Dhabi, UAE.

Correction
There may be information on the App that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, and availability. We reserve the right to correct any such errors or update information at any time without prior notice.

Disclaimer
THE APP IS PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. YOUR USE OF THE APP SERVICES IS AT YOUR OWN RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE MAKE NO WARRANTIES REGARDING THE ACCURACY OR COMPLETENESS OF THE APP’S CONTENT OR ANY CONTENT LINKED TO THE APP. WE SHALL NOT BE HELD RESPONSIBLE FOR:

• Any errors or inaccuracies in content or materials.
• Personal injury or property damage from use of the App.
• Unauthorized access to or use of our secure platform and stored data.
• Interruptions or downtimes in App availability.
• Viruses, malware, or similar issues transmitted by third parties.
• Any loss or damage caused by content posted or accessed through the App.

Limitations of Liability
UNDER NO LEGAL THEORY (INCLUDING TORT, CONTRACT, OR OTHERWISE) SHALL WE BE LIABLE TO YOU FOR:

• ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, SALES, GOODWILL, OR DATA—even if we were advised of their possibility.
• ANY DIRECT DAMAGES IN EXCESS OF THE AMOUNTS PAID BY YOU IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

THESE LIMITATIONS REFLECT AN ALLOCATION OF RISK BETWEEN THE PARTIES AND FORM THE BASIS OF THE AGREEMENT TO USE THIS APP.

Indemnification
You agree to indemnify and hold harmless Cura FZE, its affiliates, subsidiaries, and their respective officers, agents, partners, and employees from and against any claims, losses, damages, liabilities, and expenses (including reasonable attorney’s fees) arising out of:

• Your use of the App.
• Your breach of these T&C.
• Your violation of any third-party rights, including intellectual property.

We reserve the right to assume exclusive control of any matter for which you are required to indemnify us, and you agree to cooperate at your expense in our defense of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.

User Data
We will maintain certain data that you transmit to the App for the purpose of facilitating your use of the App. You are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the App. We assume no liability for any loss or corruption of such data, and you hereby waive any right of action against us arising from any such loss or corruption.

Electronic Communication
Visiting the App, sending us emails, and completing online forms constitute electronic communications. You consent to receive such communications, and you agree that all agreements, notices, disclosures, and other communications provided to you electronically satisfy any legal requirement that such communications be in writing.

YOU AGREE TO THE ELECTRONIC DELIVERY OF NOTICES, POLICIES, AND RECORDS OF TRANSACTIONS INITIATED OR COMPLETED BY US OR VIA THE APP. You waive any legal rights under any jurisdiction requiring original signatures, non-electronic records, or non-electronic methods of payment or communication.

Miscellaneous
These T&C, along with any posted policies or operating rules, constitute the full agreement between you and Cura FZE. Failure to enforce any right or provision does not constitute a waiver. These terms apply to the fullest extent permitted by law. We may assign our rights at any time. We are not liable for delays or failures due to causes beyond our control. If any term is found unenforceable, it shall not affect the validity of remaining terms. These terms do not create a joint venture, partnership, or employment relationship. You waive any defenses related to the electronic form or lack of signature on this agreement.

Reporting Security Incidents
In compliance with UAE cybersecurity laws including Federal Decree Law No. 34 of 2021 and Federal Law 5 of 2012 (as amended), we adhere to the official process for reporting digital security incidents within 48 hours.
